The Tribunal is also of the opinion shared by Member Murray in his August 8/2007 Tribunal decision that “at first blush, Section 33 of the Regulation appears to discriminate against “this” Appellant based on the very nature their disability which mandates that they be denied the additional monetary benefits afforded to “renters”.  The Tribunal is cognizant and respectful of the Ministry’s position vis-à-vis a Human Rightscomponent whereby arguments to this effect must be heard in a Stage II hearing and as such, limits its opinion on this very subject.
