Eureka!

I've been struggling to find out all the ways our welfare clawbacks target lone parent families. Tonight I found something very interesting in an old copy of The Canadian Law Times:

"For it is said that if a man marry one within the degrees prohibited, the issue between them is not by the Common Law a bastard until there be a divorce; for by that law the marriage is not till then void" (z)."

The prohibited degrees are adultery, incest and fornication. Think about kids born to unwed parents (40% of births in Canada) -- their parents can't 'divorce' however they will go to Family Court on matters of child support and custody. The child support order becomes the document 'voiding' the 'marriage' of 'fornicators' and 'adulterers', but it also confers bastardy!

Essentially this discovery makes a discrete class out of everyone who is subject to welfare's assignment of child support. Up til now I saw more than one class, depending on the marital status of the child's parents and whether there was paternal abandonment.

What is "LEVITICAL DEGREES"?

Degrees of kindred within which persons are prohibited to marry. They are set forth in the eighteenth chapter of Leviticus. LEVY v. To raise ; execute; exact; collect; gather; take up; seize. Thus, to levy (raise or collect) a tax; to levy (raise or set up) a nuisance; to levy (acknowledge) a fine; to levy (inaugurate) war; to levy an execution,
